1. Who processes your data

Two separate entities operate on artquamanima.com, each responsible for its own processing.

Art Quam Anima (AQA - PARIS) — simplified joint-stock company with a sole shareholder, SIREN 989 886 593, Paris Trade Register, 28 rue du Dragon, 75006 Paris. Publisher of the website, gallery, and seller of the workshops, Art Games and experiences.

Arnaud Quercy Créations — Arnaud Quercy, sole proprietor, SIRET 521 356 980 00024, Paris Trade Register 521 356 980, 17 avenue d'Italie, 75013 Paris. Seller of the original artworks, shipper and exporter.

For any question, or to exercise your rights, a single address: contact@artquamanima.com, or by post to the address of the entity concerned. Your request is forwarded to the competent controller.

Art Quam Anima also acts as the artist's agent for sales concluded in the gallery. In that capacity, it processes the sale data on behalf of the seller.

2. Data collected, purposes and legal bases

Browsing the website

Anonymous visit statistics are kept on the server, without advertising cookies, for security and audience measurement. Legal basis: the publisher's legitimate interest in ensuring the security and proper operation of the website.

Advertising cookies are set only with your consent (section 6).

Getting in touch

When you write to us or use a form: name, e-mail address and the content of your message. Legal basis: legitimate interest in answering your request, or steps taken at your request prior to entering into a contract when your message concerns a purchase.

Information about exhibitions and events

If you have consented to it: name and e-mail address. Legal basis: consent, which you may withdraw at any time.

Purchase of an original artwork

Controller: Arnaud Quercy Créations.

Data: identity, billing and delivery addresses, e-mail address, telephone number, country of residence, details of the order and of its payment, exchanges relating to the sale, the delivery, a request for a quotation or a withdrawal.

Purposes: conclusion and performance of the sale, invoicing, packing and shipping, export customs formalities, handling of returns and guarantees, tracking of the artwork's provenance.

Legal bases: performance of the contract and pre-contractual steps; legal accounting, tax and customs obligations; legitimate interest in the traceability and authenticity of the artworks.

Booking a workshop or an experience

Controller: Art Quam Anima.

Data: identity, e-mail address, telephone, the session booked, payment, together with the information you choose to give us so that the session runs well, in particular an allergy to a material or the presence of a minor. The latter is used only for the session concerned and is deleted afterwards.

Purposes: management of the booking, organisation of the activity, invoicing.

Legal bases: performance of the contract; legal accounting and tax obligations.

Bookings made through a third-party platform are also governed by that platform's privacy policy.

Photographs taken during an activity

No image allowing you to be identified is published without your prior written authorisation, or that of the legal representatives for a minor. Legal basis: consent.

Payment

Online payments are handled by Stripe, payments in the gallery by the gallery's payment terminal. Your bank card details are neither collected nor kept by us: they are processed directly by the payment provider, which is the controller for that processing. We keep only the proof and the reference of the payment.

3. Recipients

Your data is never sold. Depending on the nature of your relationship with us, it may be passed on to:

the payment provider (Stripe for online payments, the terminal provider for payments in the gallery);
the carrier responsible for delivering or collecting an artwork (in particular Colissimo — La Poste, or DHL): identity, delivery address, telephone and e-mail, as required for delivery;
the customs authorities, for shipments outside the European Union: the data appearing on the commercial invoice and the export declaration;
the consumer mediator (CM2C), should a dispute be referred to it, and our advisers (chartered accountant, lawyer, insurer) strictly as necessary;
Meta and Google, only if you have accepted advertising cookies (section 6);
the website host (OVH) and technical providers, within the scope of hosting and maintenance.

Between the two entities mentioned in section 1, only the data necessary for the gallery's mandate and for invoicing is exchanged.

4. Transfers outside the European Union

A delivery outside the European Union necessarily involves passing your contact details to the carrier and to the customs authorities of the country of destination. This transfer is necessary for the performance of the contract you have entered into (Article 49.1.b of the GDPR).

Our providers established in the European Union may use sub-processors located outside the Union, governed by the European Commission's standard contractual clauses or by an adequacy decision.

5. Retention periods

Messages and contact requests: three years after the last exchange.
Information about exhibitions and events: until you withdraw your consent, and at most three years without interaction.
Invoices and accounting records: ten years from the close of the financial year, in accordance with the French Commercial Code.
Export evidence and customs documents: the period required by customs and tax regulations.
Delivery and tracking data: three years after delivery, for the purposes of guarantees and of any transport dispute.
Register of artwork sales: kept on a lasting basis, the traceability and provenance of a work of art being necessary to its authenticity and to the artist's rights.
Workshop booking data: three years after the session; information given so that a session runs well is deleted after it.

6. Cookies and advertising

While you browse, no personal data is collected by default.

With your explicit consent, this website uses advertising cookies from Meta (Facebook, Instagram) and Google Ads to offer you relevant content elsewhere on the web. They load only after you accept: if you refuse, no advertising cookie is set and nothing is sent to Meta or Google. You may accept, refuse or change your mind at any time from the preferences panel below. Refusing changes nothing to your visit.

Cookies that may be used: aqa_consent (essential, remembers your choice, about six months); Meta _fbp and _fbc, Google _gcl_* (advertising, only if you accept).

7. Your rights

Under the conditions provided for by the GDPR, you have the rights of access, rectification, erasure, restriction, objection and portability of your data, as well as the right to withdraw your consent at any time and to give directions as to what becomes of your data after your death.

These rights are exercised at contact@artquamanima.com or by post to the address of the controller concerned (section 1). A reply is sent to you within one month.

Some data cannot be erased at your request: data that the law requires us to keep, in particular invoices and customs documents, and data necessary for establishing or defending a legal claim.

You may also lodge a complaint with the French data protection authority, the Commission nationale de l'informatique et des libertés (CNIL), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, www.cnil.fr.

8. Changes

This policy may be amended to take account of changes in our activities or in the applicable regulations. The applicable version is the one published on this page on the date of your visit.
